In order to facilitate exit and entry customs clearance for travelling traders from different countries and to establish the order, on the basis of theAdministrative Measures of the Customs of the People’s Republic of China for Goods Temporarily Imported or Exported(No. 233 Decree of the General Administration of Customs), theLaw of the Peoples Republic of China on Import and Export Commodity Inspection,theLaw of Peoples Republic of China on the Entry and Exit Animal and Plant Quarantine,theLaw of Peoples Republic of China on Frontier Health and Quarantineand theLaw of the Peoples Republic of China on Food Hygiene,theCustoms Clearance Guidelines on Exit and Entry of Exhibits for 2018 Guangdong 21stCentury Maritime Silk Road International Expo(hereinafter referred to as “theCustoms Clearance Guidelines for the MSR Expo”) is hereby formulated for reference to ensure exhibits can be admitted to the MSR Expo for safe, punctual and successful exhibition.
一、Entry Regulations on and Registration of Inbound Exhibits
Exhibitors of the 2018 Guangdong 21stCentury Maritime Silk Road International Expo (hereinafter referred to as “the MSR Expo”) shall, prior to importation of exhibits into China, submit to Dongguan Customs such materials as a list of exhibits and exhibition participation certificate to go through relevant formalities.
(一)Entry Requirements for Inbound Exhibits
1. Articles listed in the Catalog of theList of the Peoples Republic of China of Articles Prohibited from Import and Exportare prohibited from entering China in the form of exhibits. (See Schedule 1);
2. Articles listed in theProhibition List for Inspection and Quarantine during the MSR Expoand theRestriction List for Inspection and Quarantine during the MSR Expo(See Annex 1 and Annex 2);
3. Exhibits like animals, plants and their products and special articles that are subject to quarantine examination and approval. Before bringing them into China, exhibitors shall file an application to Dongguan Customs and have them examined and approved by the competent entry-exit inspection and quarantine authority. (See Annex 3)
(二)Inbound Exhibit Registration Application
Application for registration of inbound exhibits may be made via the “Special Service Window and Line” (address: Customs Service Building, No. 17, Baiye Road, Liaobu Town, Dongguan City; Contact No.: 0769-22004507) set up by Dongguan Customs 20 days prior to their entry into China, and the following materials are required:
1.Exhibition Registration Application Form (Schedule 2);
2.Approval documents issued by competent national authorities;
3.List of Inbound Exhibits (Schedule 3);
4.Floor plan of the exhibition venue and list of exhibitors;
5.Inbound Exhibit Consignee/Agent Registration Application Form (Schedule 4, only applicable to importation of exhibits that are animal and plant derived food);
6.Relevant permits are required for exhibits whose importation is restricted by the state.
7. List of Inbound Articles for the MSR Expo (articles to be expended and distributed only during the MSR Expo);
8. Disposal plan for inbound exhibits after the MSR Expo is closed;
9. Management measures and safety responsibility statement for inbound exhibits (including animals, plants, animal & plant products, animal & plant derived food, and wastes of special articles) during the MSR Expo;
10.Other materials the customs authority considers necessary.
二、Pre-exhibition Management of Inbound Exhibits
(一)Declaration and Inspection & Quarantine Management of Inbound Exhibits
1.Declaration of Inbound Exhibits
According to the No. 233 Decree of the General Administration of Customs, exhibits for the MSR Expo shall be declared for entry and exit in the form of exhibits and in the mode of customs clearance integration. Declaration formalities will be processed by GD Modern International Exhibition Center (hereinafter referred to as “the Exhibition Center”) or its authorized agent at Dongguan Customs and inspection and release of inbound exhibits will be executed by the port customs.
Concerning the temporarily imported goods for the MSR Expo, which are under the items of ATA Carnet, competent customs will conduct the check and endorsement, and the expiration date of re-exportation shall be the same as that of the ATA Carnet.
2.Inspection and Quarantine Management of Inbound Exhibits
(1)For exhibits that are animals, plants and their products and special articles subject to quarantine examination and approval, a copy ofQuarantine Permit for International Exhibition(Schedule 5) orInbound Animal and Plant Quarantine Permitand also a list of exhibits (Schedule 6) shall be submitted. For exhibits that are special articles,Application of Import/ Export Special Articles for Verification of Health and Quarantineshall be provided in addition to aforesaid materials.
(2)Animal and plant products as well as animal and plant derived food that have been eliminated risks of animal and plant disease spread after deep processing can be exempted from quarantine examination and approval. Upon customs clearance, exhibitors are exempted from providing the certificate of quarantine issued by the exporting country or region. However, for animal and plant derived food, the certificate of hygiene issued by the exporting country or region shall be submitted upon customs clearance.
(3)For the animal and plant products in the GMO (genetically modified organism) list and their foretaste and trial products, whether they are "transgenic" or not shall be stated; if yes, a "GMO Safety Certificate" shall be issued by the Ministry of Agriculture as for the transgenic ingredients.
(4)Import pre-packaged food or cosmetics only for exhibition can be exempted from sampling inspection and labeling in Chinese. Articles used as food samples or trial products during the exhibition shall or shall not undergo sampling inspection depending on the decision made by the customs inspectors after risk assessment, and they are allowed for foretaste or trial use and exempted from labeling in Chinese only after they are assessed as qualified.
For import pre-packaged food and cosmetics that is exempted from labeling in Chinese, notes on name, direction/usage and taboo should be listed in Chinese next to the exhibits.
(5)For exhibits listed in the catalogue of CCC, the holders of ATA Carnet or CCC Certificate may directly go through customs clearance formalities. For other exhibits, exhibitors may be exempted from getting a CCC Certificate, but shall provideExhibition Registration Application Form(Schedule 1),List of CCC Exhibits(Schedule 7) andCCC Exhibits Registration Formfor customs clearance formalities.
(6)Inbound exhibits subject to isolation and quarantine according to relevant regulations, shall be isolated and quarantined before they are put on exhibition.
(二)Inspection of Inbound Exhibits
1.Inspection by Dongguan Customs
For exhibits that are delivered to the Exhibition Center in their original containers with the seal unbroken after entering China, Dongguan Customs inspectors shall, according to relevant regulations, inspect the exhibits and their containers, packages and bedding materials in the exhibition hall, including animal and plant quarantine, health quarantine and radioactivity monitoring, and carry out quarantine treatment accordingly.
2.Inspection by Port Customs
For exhibits in bulk or to be unloaded at the port and re-transported to the exhibition hall, inspectors of the port of entry shall, according to relevant regulations, inspect the exhibits and their containers, packages and bedding materials at the port, including animal and plant quarantine, health quarantine and radioactivity monitoring, and carry out quarantine treatment accordingly.
三、Disposal of Inbound Exhibits after the Exhibition
(一)Deregistration of Exhibits
After the closure of the MSR Expo, exhibitors shall provide Dongguan Customs with the following materials for deregistration of exhibits:
1.Exhibition Registration Application Form
2.List of Inbound Exhibits
3.Import Declaration or ATA Carnet
4.Application Form for Articles Used for the MSR Expo
5.Inbound Exhibits Deregistration Form (Schedule 8)
(二)Examination and Approval of Articles Used for the MSR Expo
Exhibitors shall submit the written report on consumption forecast to Dongguan Customs ahead of schedule, and specify the planned usage mode (for trial, taste, and distribution) and quantity (which should be within a reasonable range, matching the event scale) of exhibits. For articles to be tried, tasted, and distributed, relevant exhibitors shall provide qualification certificate (official certificate of the country where exhibitor belongs to, or the third-party testing report, or self-check qualification report of the exhibitor) meeting the requirements and situation statement issued by the Exhibition Center, and only after approval of Dongguan Customs can such articles be used in the MSR Expo.
The Customs will, in line with actual conditions, check and verify the quantity and total value of the following import articles used for the MSR Expo. The tariff, value-added tax and consumption tax for import will be exempted according to relevant regulations, if the aforesaid quantity and total value are within a reasonable range.
1.Small samples (excluding alcoholic beverage, tobacco, and fuel) in activities for the MSR Expo, including imported food or beverage samples with original packaging, or such samples made of bulk raw materials imported during the MSR Expo;
Such goods shall meet the following conditions:
(1)They will be offered by exhibitors for free during the MSR Expo, which are exclusive for visitors to use or consume;
(2)The samples with low unit price will be used for advertisement;
(3)They will not be applied for commercial use, with their unit capacity obviously smaller than that of the smallest retail packaging;
(4)Food and beverage samples are actually consumed in the activities although they have not been distributed in accordance with the packaging ruled in Item (3) under this clause.
2.Materials consumed or damaged to set the operating examples for exhibited machine or device;
3. Low-value goods consumed for setting and decorating the temporary booth;
4. Relevant publicity materials distributed to visitors for free during the MSR Expo;
5. Files, tables and other documents used for the MSR Expo.
The part exceeding the limited import quantity of the MSR Expo-used articles listed in above Clause 1 shall be taxed pursuant to laws; unused or unconsumed parts of those listed in above Clauses 2, 3 and 4 shall be re-exported, or imported in line with regulations.
(三)Disposal of Exhibits after the Exhibition
1. The temporarily imported exhibits for the MSR Expo shall be re-exported within the period provided by the Customs. If they are damaged due to force majeure and therefore cannot be re-exported in the original form, the MSR Expo organizer and the exhibitor shall timely report to the competent customs authority. They may, upon the strength of the certification documents issued by the relevant authorities, go through the re-exportation formalities. In the case of destruction or loss due to force majeure, such goods may, upon verification by Dongguan Customs, be deemed to have been re-exported.
2. For exhibits that are imported along with theCCC Exhibits Registration Formand need to be re-exported after closure of the MSR Expo, export declaration andInbound Exhibits Deregistration Formshall be provided and verified. If CCC exhibits are expected to be sold or used domestically, application shall be made for the certification. Before such certification is acquired, these exhibits cannot be sold or used domestically.
3. Exhibits subject to destruction shall be destroyed under the guidance of the Customs. Such exhibits as food, cosmetics, animals, plants, animal & plant products and special articles, shall be sent to qualified places for destruction, and then theInbound Exhibits Deregistration Formshall be filled out.
4. For sold exhibits, relevant formalities shall be gone through according to law.
四、Exhibition Personnel and Personal Articles
(一)Exhibition Personnel
Personnel receiving the entry quarantine must, according to requirements of quarantine doctors, truly report the physical condition, and show the certificate of prophylactic vaccination for infectious disease, health certificate, or other valid certificates. Personnel proved to be with entry-forbidden diseases (serious mental disease, infectious phthisis, or other infectious diseases possible to cause major dangers to public health) by Port Quarantine shall not be permitted for entry.
(二)Personal Articles
1.Taxation and Exemption
The principle of “self-use and reasonable quantity” shall be followed for general daily articles carried by individuals. The personal articles within the duty-free scope ruled by the Customs will be exempted from import duties and taxes, but the articles exceeding the aforesaid scope will be taxed, and then, permitted for entry. The procedures of customs clearance shall be processed pursuant to relevant rules in the event of personal articles exceeding the scope of “self-use and reasonable quantity”.
Individual shall declare to the Customs for his/her inbound personal articles through the unaccompanied luggage mode, when he/she enters into China. After the unaccompanied luggage arrives, the individual himself/herself or his/her broker shall submit the written application to the Customs, and process the procedure at Customs of the place from which he/she enters by valid ID document, certificate related to declaration, the article list, etc. Before leaving China, individual or his/her broker shall submit the application to Customs of the place from which he/she will leave by valid exit certificate, and process the procedure of the customs clearance pursuant to regulations for his/her personal articles going to leave the border as unaccompanied luggage. The Customs will, according to regulations, exempt the tax on personal articles within the duty-free scope, and release them. Customs clearance procedure will be processed based on relevant rules for those exceeding the scope of “self-use and reasonable quantity”.
A limited value of 800 Chineseyuaneach time is set for articles mailed by individuals from or to Hong Kong, Macao or Taiwan; such limited value is 1,000 Chineseyuanfor those from or to other countries and regions. Inbound and outbound articles mailed by individuals, which exceed the value limit, shall be processed for returned cargo procedure or customs clearance procedure in line with the rules. However, if there is only one indivisible item in the parcel, which exceeds the value limit but is checked and proved by the Customs to be for self-use, it can be processed for customs clearance procedure as individual article. In terms of inbound articles mailed by individuals, which are imposed with import duty by the Customs according to law, the import amount due less than 50 Chineseyuan(including 50 Chineseyuan) shall be exempted by the Customs. The transported commercial parcel for import and export shall be processed for customs clearance procedure pursuant to cargo rules.
2.Inspection and Quarantine
The articles carried by individuals shall meet the requirements of theAdministrative Measures on Quarantine of Articles Carried by Entry-Exit Passengers(originally announced in the No. 146 Decreed of General Administration of Quality Supervision, Inspection and Quarantine and revised according to the No. 238 Decreed of General Administration of Customs) and theCatalogue of Animals and Plants, and Animal and Plant Products Prohibited from being Carried or Posted into the People’s Republic of China.
When special articles (biological or blood products) carried by individuals for self-use and only for prevention or treatment of diseases enter the border, related hospital proof shall be showed to the Customs pursuant to theAdministrative Regulations for Health Quarantine on Special Entry-Exit Articles(originally announced in the No. 160 Decreed of General Administration of Quality Supervision, Inspection and Quarantine and revised according to original No. 184 Decreed of General Administration of Quality Supervision, Inspection and Quarantine and No. 238 Decreed of General Administration of Customs), and the carried quantity for a course of treatment determined by the prescription or specification is allowed. TheApplication of Import/ Export Special Articles for Verification of Health and Quarantineshall be provided in accordance with theAdministrative Regulations for Health Quarantine on Special Entry-Exit Articlesfor the self-used special articles unable to offer evidentiary materials pursuant to the requirements, and such articles shall be inspected and quarantined by the Customs.
3.Companion Animal
Participants can each bring one companion animal (a dog or a cat) into China. The animals from non-rabies countries or regions with the bill of health, vaccination certificate and electronic chip can be directly released without isolation and quarantine by the port customs upon on-site quarantine inspection. If there is no vaccination certificate, the carrier may submit the application and the customs may release the animal after inoculated. The animals from rabies-prevalent countries or regions with the bill of health, vaccination certificate, electronic chip, and the rabies antibody test report (with a titer greater than 0.5 IU/ml) issued by the lab accredited by World Organization for Animal Health can be directly released without isolation and quarantine by the customs upon on-site quarantine inspection.
五. Journalists’ Recording Equipment
For the temporary import of recording equipment brought by foreign journalists into the MSR Expo, customs clearance procedures shall be handled in accordance with the relevant announcements in No. 104 of 2008, No. 19 of 2009 and No. 31 of 2009 issued by the General Administration of Customs.
For inbound and outbound materials for the MSR Expo which fail to go through the customs formalities as required, the Customs shall follow the relevant provisions of theRegulations of the Peoples Republic of China on Implementing Customs Administrative Penalty.
